Acceptable Use Policy

As a provider of web site hosting and other Internet-related services, Crisaleo Limited offers its customer (also known as "Subscribers") and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Crisaleo Limited respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Crisaleo Limited reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, Crisaleo Limited has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using Crisaleo Limited services. This AUP will be revised from time to time.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Crisaleo Limited cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because Crisaleo Limited cannot monitor or censor the Internet, and will not attempt to do so, Crisaleo Limited cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.

When subscribers disseminate information from the Internet, they must keep in mind that Crisaleo Limited does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over Crisaleo Limited network and may reach a large number of people, including both subscribers and non-subscribers of Crisaleo Limited, subscribers' postings to the Internet may affect other subscribers and may affect Crisaleo Limited goodwill, business, reputation or operations. For these reasons, subscribers violate Crisaleo Limited policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:

Spamming:

Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Crisaleo Limited, but also because it can overload Crisaleo Limited network and disrupt service to Crisaleo Limited subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Crisaleo Limited will investigate and shutdown the account that is spamming. A £375.00 GBP charge for violating this policy will be charged to the person initiating the SPAM. Furthermore Crisaleo Limited reserves the right to prosecute for this violation. A £2.50 GBP charge will be assessed PER EMAIL sent should Crisaleo Limited choose to pursue and prosecute.

Audio/Video StreamingAdult-Oriented Content:

Crisaleo Limited does allow adult content. You must have a disclaimer, the content must be legal within the United Kindom.

Large File Policy:

Crisaleo Limited is not for file hosting and distribution - as such, customers may not host any files larger than 100MB in size that are observed to be available for the sole purpose of download. Such files include but are not limited to .ISO, audio/video files, .EXE files. If you are unsure whether your file is against this policy, please e-mail [email protected]

Obscene Speech or Materials:

Using Crisaleo network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Crisaleo Limited is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

Defamatory or Abusive Language:

Using Crisaleo Limited network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

Forging of Headers:

Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks:

Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities:

Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

Facilitation a Violation of this AUP:

Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

Export Control Violations:

Exporting encryption software over the Internet or otherwise, to points outside the United Kindom.

Usenet Groups:

Crisaleo Limited reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities:

Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Other Activities:

Engaging in activities, whether lawful or unlawful, that Crisaleo Limited determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.

Cookies:

A cookie is a small text file that is stored on a users computer for record-keeping purposes. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site. We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser. A persistent cookie remains on your hard drive for an extended period of time much like the cookie used for our affiliate program. You can remove persistent cookies by following directions provided in your Internet browsers 'help' file. We set a persistent cookie to store your passwords, so you do not have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our site. Log files:

We do not link this automatically-collected data to personally identifiable information. IP addresses are tied to personally identifiable information to prevent and block abusers to keep using our services such as members who violates our terms of service. We use a third-party tracking service that uses cookies and log files to track non-personally identifiable information about visitors to our site in the aggregate of usage and volume statistics to determine how our users navigate through our website and to know how many users are using our services demographically. We use the information you provide about yourself or others to complete the transaction for which it is intended. This may include administering a service such as registration, email, forum, etc., or contacting you if you have indicated your permission to do so by agreeing to accept further notification and service announcement from us on your member profile page. You can choose to opt-out from receiving any further notification from your member profile page. We do not share this information with outside parties.

Surveys:

Upon using our free services, you may be requested to participate in our periodic internal surveys that are conducted by Crisaleo Limited to determine your personal interests. These surveys are strictly voluntary. The data collected through these surveys will only be used to improve our products and services and will never be sold to any third parties.

Communications from the site

When we receive email, we use return email addresses to reply with the information requested. Such addresses are not used for any other purpose and are not shared with outside parties. When supplying contact information to Crisaleo Limited you can indicate your preference if you would like to be contacted to receive information and updates about our services by logging in to your Crisaleo Limited account, going to your member profile page and choose not to receive any further notification emails from us or other information pertaining to Crisaleo Limited. Information you submit to us will not be used for this purpose unless you indicate this as your preference. When supplying contact information to Crisaleo Limited you can indicate your preference on your members profile page to participate in the Crisaleo Limited newsletter. You will receive a confirmation email from us when placing an order on our site and paying through PayPal.

Newsletters

We provide you the opportunity to 'opt-in' and 'opt-out' of our newsletter at any time. Our newsletter is sent every month so it will certainly contain allot of useful information and any offers we may have. If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them at any time.

Information sharing and disclosure

We collect information from our website visitors using Google Analytics. We use this information to better design our Web site and services. This information is never shared with any third party. We do not link aggregate user data with personally identifiable information.

Personally identifiable information

Crisaleo Limited does not share, sell, rent, or trade personally identifiable information with third parties. We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described within this privacy policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.

How can you access/correct your information

You can access all your personally identifiable information that we collect by logging into your password-protected Crisaleo Limited account and selecting to update your 'My Details' We use this procedure to better safeguard your information. You can also correct factual errors in your personally identifiable information by sending us a request that credibly shows error. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.

Specific Terms and Conditions

Crisaleo Limited considers email transmitted via our service to be the private correspondence between the sender and recipient. We will not monitor, edit or disclose the contents of a user`s private communications, except as required by law, to comply with legal process, if necessary to enforce the Service Agreement, to respond to claims that such contents violate the rights of third-parties, or to protect the rights or property of Crisaleo Limited. By using the service you agree that technical processing of email communications is and may be required to send and receive messages, to conform to the technical requirements of connecting networks, to conform to the limitations of the Service, or to conform to other, similar technical requirements. By using the service you acknowledge and agree that Crisaleo Limited do not endorse the content of any user communications and are not responsible or liable for any unlawful, harassing, libelous, privacy invading, abusive, threatening, harmful, vulgar, obscene, tortuous, or otherwise objectionable content, or content that infringes or may infringe the intellectual property or other rights of another.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Web site.

As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. Crisaleo Limited will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with Crisaleo Limited policy or applicable law. However, when Crisaleo Limited becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by Crisaleo Limited.

Crisaleo Limited is also aware that many of its subscribers are themselves providers of Internet services, and that information reaching Crisaleo Limited facilities from those subscribers may have originated from a customer of the subscriber or from another third party.

Crisaleo Limited does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers. Crisaleo Limited reserves the right to directly take action against a customer of its subscribers.

Also, Crisaleo Limited may take action against the Crisaleo Limited subscriber because of activities of a customer of the subscriber, even though the action may affect other customers of the subscriber. Similarly, Crisaleo Limited anticipates that subscribers who offer Internet services will cooperate with Crisaleo Limited in any corrective or preventive action that Crisaleo Limited deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of Crisaleo Limited policy.

Crisaleo Limited will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. Crisaleo Limited may, however, monitor its service electronically to determine that its facilities are operating satisfactorily.

Also, Crisaleo Limited may disclose information, including, but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Crisaleo Limited assumes not obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, Crisaleo Limited may disclose subscriber information or information transmitted over its network where necessary to protect Crisaleo Limited and others from harm, or where such disclosure is necessary to the proper operation of the system. However, Crisaleo Limited will never sell information to other services or outside companies.

Crisaleo Limited expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber's failure to comply with those laws will violate Crisaleo Limited policy. Finally, Crisaleo Limited wishes to emphasize that, in

signing the Service Agreement, subscribers indemnify Crisaleo Limited for any violation of the Service Agreement, law or Crisaleo Limited policy resulting in loss to Crisaleo Limited or the bringing of any claim against Crisaleo Limited by any third party. This means that, if Crisaleo Limited is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will be responsible for payment of any damages awarded against Crisaleo Limited, plus costs and reasonable attorney's fees.
